　　在新疆石河子监狱的1号综合楼里，囚犯牛玉强以“窝囊”而闻名。

　　打饭的时候，大师傅给别人盛两勺菜，只给他盛一勺。他常要加班做工，回来时，狱友们大多已睡了一觉。

　　但他从不申诉，也不抱怨。以至于，有人给这个1963年出生的瘦子起了个外号：植物人。

　　有一次，一个年轻的囚犯指着牛玉强的鼻子说：“就你这样的，都给罪犯丢人！”

　　他的确太老实了。即使是和最熟悉的狱友说话，他也习惯性地埋着头，声音小而缓慢。

　　狱友们侃大山时，他就一个人坐在床边，翻出儿子的照片，看一遍，再看一遍。

　　“你是顶罪进来的吧？”在走廊上或食堂里，常有陌生的狱友这样问他。

　　他们大都不知道，眼前这个已经谢顶的中年人，曾经被判“死缓”，而他背了26年的罪名，叫做流氓罪。

　　监狱里的大部分囚犯都不知道这段往事了。算上牛玉强在内，当年因为流氓罪而服刑的囚犯如今只剩下3个，而按照预计刑期，牛玉强将是全中国最后一个走出监狱大门的“流氓”。

　　1983年，我国开始第一次“严打”，9月，《关于严惩严重危害社会治安的犯罪分子的决定》公布，6种犯罪行为被大幅提高量刑幅度，其中，流氓罪列于首位。

　　到处都是警察。每天都有人被押往公判大会，每天都有“犯罪团伙”被捣毁。

　　北京京棉二厂的模范员工韩秀金一度认为这与她毫无瓜葛。但就在当年初春的一个晚上，大女儿牛玉燕和二女儿牛玉红哭着站在了工厂门口。

　　儿子牛玉强出事了。

　　根据后来送交韩秀金的《刑事判决书》描述，牛玉强参与了流氓团伙“菜刀队”。他犯下的罪行包括：持械抢劫一名男青年，抢走一顶军帽；纠集同伙，将刘红家的窗玻璃砸碎；纠集同伙，威胁与殴打一名叫许林的青年。

　　对他的量刑是：死刑，缓期两年执行。

　　时至今日，75岁的韩秀金依然能清晰记得大喇叭广播里高亢的声音：“从重从严从快，绝不放过一个坏人！”

　　“做梦也想不到大强敢打人！”2010年12月5日，几个老邻居聚到牛家，仍然忘不了当年的惊讶。

　　关于牛玉强的一切记忆都和“流氓”无关。他小时沉默、腼腆，喜欢画画，最喜欢画的是马。

　　他从来不穿脏衣服，比两个妹妹还喜欢照镜子。他很小就会学了做饭，而且喜欢做饭。

　　街坊们都说，大强像个大姑娘。

　　但在韩秀金看来，毁就毁在“太大姑娘了”。

　　在京棉厂宿舍大院儿里，没上学的孩子有十几个，他们拉帮结派，没考上高中的牛玉强也“入了伙”。韩秀金说，大强的性格是别人说东，他肯定不敢说西，“不敢不去啊”。

　　在孩子们里，他的岁数最大，却只能当“小弟”、“跟班”。韩秀金坚持认为，儿子是想脱离他们的，好几次,[link widoczny dla zalogowanych]，有“大哥”来找他的时候，他都会躲在门后，冲着母亲做出“说我不在”的口型。

　　后来，这群孩子成了“菜刀队”，其中有两个，被判死刑，立即执行。这个被粉碎的犯罪团伙，没有一个罪犯超过20岁。

　　1984年，没被枪毙的流氓犯都被送到石河子监狱劳动改造。牛玉强也在其中。

　　回首一起服刑的日子，当年的狱友刘海龙对牛玉强的评价是，“一脚踢不出个屁来”，“太窝囊”。

　　他爱抽烟，却从不给管教“上供”。大伙陪着狱警“唠嗑儿”，他却闷着头发呆。

　　睡觉的时候，他被安排在30米长大通铺的最尽头，离他半米远处，是两个大桶，一屋子囚犯的拉撒，都要在桶里解决。

　　“好事儿准没他，苦活累活一准儿找他。”田跃进是牛玉强的老乡，他曾试图“提点”牛玉强。但他说，“牛玉强跟我们真不一样，别说监狱，就算在社会上，也是一受欺负的主儿”。

　　牛玉强似乎只有一个念想：“劳积(劳动积极分子)，减刑，劳积，减刑。”“没有人比他更听话。”刘海龙说，牛玉强从不叫苦，也不申诉，“就拿自己当牛，当马。”

　　劳改的工作是修水库，要运沙土上山。别人拉五六百斤的沙土，牛玉强拉七八百斤。刘海龙记得，牛玉强个子太小，拉车时稍一低头，就只能看见车在走。

　　1990年，因在服刑期间表现良好，牛玉强被连续两次减刑，改判为有期徒刑18年。就在同年，由于超强度的体力劳动，他患上了严重的空洞性肺结核。

　　年底，他被老父亲接回北京，体重不足90斤。

　　1991年，石河子监狱方面组成的保外就医考察组曾来到牛玉强家中。经过评估，做出续保一年的决定，但据牛家人介绍，之后再没有人来过。次年，牛玉强大病初愈。

　　街坊们说，大强变得更蔫儿了。

　　他很少出门，只是闷在家里写思想汇报，然后送到派出所，送到居委会，送到街道的司法所。他很少跟人说话，碰见街坊也会刻意低头，甚至买菜时也从不讲价，理由是“避免吵架”。

　　1996年，在朋友介绍下，他开始与朱宝侠处对象。头回见面，他第一句话就是，“我是个犯人”。

　　妻子朱宝侠说，嫁给牛玉强，纯粹是图他老实。

　　在监狱里，牛玉强的右胳膊落下了习惯性脱臼的毛病，有时睡着觉就会脱臼。但他不去医院，30元接一次，他嫌太贵。他让老父亲使劲儿帮他往上推，疼得嗷嗷叫。

　　街坊们说，结婚这么多年，没见小两口“红过脸”。“红，怎么不红。”朱宝侠突然捂着嘴笑，她说，一发生分歧牛玉强就不说话了，把意见都写在纸上，再塞过来。

　　2000年，他们生了个儿子。一到晚上，牛玉强就抱着儿子，哄他睡觉。朱宝侠一度以为，日子就会这么平凡地过下去，还有点幸福。

　　不过，2004年4月，这种日子到头了。两个穿深色夹克的狱警突然来到牛玉强家，要带他回新疆服余刑。

　　“怎么14年了都没个信，说带走就要带走了！”朱宝侠急得直跺脚，牛玉强却不说话，一扭头进了里屋。朱宝侠再三央求，狱警答应明天再来押人。等她送客后回到里屋时，牛玉强已经收拾好行李，“就差装鞋了”。

　　牛玉强是第二天中午离开的。临走时，他没说太多话，使劲抱了抱刚5岁的儿子。

　　到了监狱，他又一次遇到了田跃进。1984年，牛玉强刚进监狱时就认识了他。田跃进是直接被带进面包车的，之前刚给上小学三年级的儿子洗完澡。

　　事实上，和牛玉强同期突然被抓回去的“在逃犯”，共有27人。而这27人被缉拿时，都已成家。

　　牛玉强后来才被告知，保外就医的十几年被监狱认定为“在逃未归”，将不算入刑期，他的刑期被顺延到2020年2月21日。知晓这个消息时，家里刚申请到“低保”，这还是牛玉强临走前给居委会做义工，铲电线杆上的小广告，才争取来的。

　　石河子监狱向中国青年报作出的官方回复是，牛玉强长期脱离居住地，谁也找不到他，因此先后于1999年和2001年分别对其进行了网上追逃，无果后才派人押回。但朱宝侠觉得不服，她说，大强恨不得每天都去派出所报到，怎么就成在逃了。

　　长期跟踪此事的《法制晚报》记者辰光，曾得到一份石河子监狱于1998年11月25日签发的《提请对保外就医罪犯执行监督考察通知书》的存根，上面有牛玉强的名字，辰光说，这就意味着直至1998年，监狱都承认牛玉强保外就医的合法性，“谁也找不到他”一说极易被推翻。

　　另一个事实是，1995年，司法部监狱管理局曾对一起因狱警失职而引发的超期保外就医案件作过批复，超期期间应计入执行刑期。

　　这让朱宝侠有了一丝期待。她念叨说，牛玉强是草民，但草民也是人，“这不是法治社会么，不相信法律，我还能信啥？”韩秀金则对每一个到访的记者作揖。茶水刚喝一口，她就会起身倒满。“大强进去的时候还是个孩子呢。”她颤抖着说，“2020年，他就是个老头了！”

　　她觉得，儿子没杀人没放火，窝囊一辈子，凭什么。

　　“牛玉强现在是太可怜了。”老狱友王友立告诉记者，在狱中，牛玉强患了高血压，但为了不减工分，他拒绝住院。他比以前更沉默，每天快熄灯时，他就捧着儿子的照片看，看着看着就哭。

　　朱宝侠告诉记者，他们一年只被允许打3分钟的亲情电话。打电话的时间通常是大年三十，她说，只有那时候，一贯慢吞吞的牛玉强才会起急，说话才会“又快又大声”。

　　他会戴上表。快到一分钟时，他急着让妻子喊老妈；快到两分钟了，他又着急要听儿子的声音。3分钟太短了，短到他从来没有说出过再见两个字。每每挂了电话，一家三口都会抱头痛哭。

　　平时，书信是一家人的唯一寄托，最近半年来，牛玉强寄回家的信越来越少，也越来越短。朱宝侠猜测，这肯定是因为“大强太累了”。她捧着一沓子丈夫的来信念给别人听：“老婆我好困，就写到这里吧”；“为了儿子，我才活着”；“我的信越来越少，你和儿子会生气吧。生气也好，那样我就会打喷嚏，就能感受到你们了。”

　　在朱宝侠的房间，能找到很多钉在墙上的老照片，其中大多是儿子，从牛玉强离家那年起，她就经常为儿子拍照片，每年都拍，每月都拍，她说，等大强回来了，能再看儿子长大一遍。

　　老照片中，最大的一张是牛玉强夫妇的新婚照。那是1997年的11月8日，没有婚纱，没有钻戒，他们只是“破天荒”地在厂里的饭馆摆了两桌喜酒。照片里，朱宝侠穿着烟儿色带花毛衣，牛玉强则新买了一身藏蓝色西装。那天，牛玉强格外高兴，少言寡语的他居然主动拉着新婚妻子，表演了一首《纤夫的爱》。

　　朱宝侠记得，当年的“流氓犯”贴着耳朵对自己说，“媳妇儿，我们要安安稳稳地过日子了”。

　　一个他们从不知道的新闻，就在1997年，《刑法》重新进行了修订。此次修订中，原流氓罪被正式取消，并具体分解为聚众淫乱罪、聚众斗殴罪、寻衅滋事罪等罪，量刑最高的可判10年以下有期徒刑。

　　流氓罪的取消，被公认为中国法治社会日趋完善的标志之一。
